Legal framework or WHAT DOES LAW SAY?

The Constitution of the Slovak Republic is the fundamental document that prohibits discrimination and guarantees religious freedom and freedom of conscience in Slovakia. It contains the Bill of Basic Rights and Freedoms and regulates state duties toward citizens or other residents. According to article 12 paragraph 1 of the Constitution "People are free and equal in dignity and rights."

Environs of discrimination or WHERE DOES IT HAPPEN?

  • In employment and profession

It is considered discrimination if, based on religion, a person is treated unfavorably in application for employment, awarded less compensation for equal work, provided unjustifiably lower work conditions than others, or intimidated for their faith by bullies in the workplace. It would also be discriminatory if the trade authority caused trouble for a new business selling Buddhist occult items and literature in town XX.

Means of discrimination or HOW DOES IT HAPPEN?

  • Discrimination by active involvement

If a state authority or private or juristic body takes measures to penalize a person because of religion or belief, it is considered discrimination. If an employer refuses to give a job to a candidate simply because the applicant is presumably a Jehovah ’s Witness, then the employer is committing a discriminatory act (regardless of whether or not the candidate is actually a Jehovah ’s Witnesses).

The history of discrimination or WHO IS IMPACTED BY IT AND WHY?

  • Selected examples from the history of Europe

The history of Europe is full of examples of religious intolerance, discrimination on grounds of belief, and violence and bloodshed in the name of faith.

The truth however, is that in most cases religion has represented only a façade covering the actual (economic or political) reasons for depriving “other-believers” of their rights, and often lives as well. States and their governors exploited religion as a pretense to rob or murder inconvenient or wealthy groups of society.
